If a foreign account or home is in more than one name, Hacienda looks at the total, not your share. A €60,000 example. Gananciales, authorised persons, and what happens if the holder dies.
This guide explains what to do on Modelo 720 if an account or a home is in more than one name, if you are married under gananciales, or if there is an inheritance. With Aitax you upload the documents: the AI takes care of the heavy lifting. You check that the figures are right. If a question comes up, you ask the specialised AI, trained on the law as it stands.
If a foreign account or home is in more than one name, Hacienda looks at the total — not your share.
Example: two of you share a €60,000 account. Your half is €30,000. For Modelo 720 that account counts as €60,000. If on 31 December your foreign accounts add up to more than €50,000, you must file. On the form you put €60,000 and, in another field, your 50 %.
Modelo 720 is only a snapshot for Hacienda of what you hold abroad on 31 December. It is not a tax: filing it does not mean paying. The €50,000 is checked by group (accounts, securities or property), across everything you hold abroad. The detail is in the guide to when Modelo 720 is required.
Updated 11 October 2026. Sources: AEAT Modelo 720 FAQs (Agencia Estatal de Administración Tributaria, the Spanish tax agency; sections shared ownership, who must file and death; updated February 2025), Order HAP/72/2013 and Royal Decree 1065/2007.
Hacienda does not split the €50,000 among the names on the contract. The same rule applies to a home or to shares.
On the form you put the full value and your percentage. If two of you own 50 % each, each puts €60,000 and 50 %. You do not put only your €30,000.
The AEAT gives another example: a €150,000 account; a company at 70 % and a person at 30 %. The person puts €150,000 and 30 %.
If you are the only holder, the percentage is 100.
Under gananciales, what you buy during the marriage belongs to both of you. Modelo 720, though, looks at the bank contract.
If the account or home is in one spouse’s name only and both of you are Spanish tax residents, both of you file.
The spouse who signed files as holder (code 1) and puts 100 %. The other files too: they own it even though they did not sign. On the form that is beneficial owner (code 8), with 50 %. Both put the full amount.
It can look odd: one puts 100 % and the other 50 %. That is the AEAT’s rule. You do not “fix” it by putting 50 % on both lines. The legal detail is in article 4.2 of Law 10/2010.
You can operate the account without owning it. Even so, if your foreign accounts add up to more than €50,000, you may have to include it. On the form that is code 3, “Authorised”.
Two simple rules:
If you already reported it as authorised and that permission is taken away, tell Hacienda: the balance and the date you stopped being authorised.
If someone who already filed Modelo 720 dies, Hacienda must be told that person is no longer the holder of those assets.
Until someone accepts the inheritance, the herencia yacente files: the deceased’s assets not yet shared out. When an heir accepts — even in practice, without a notary — they file.
If those assets never reached €50,000, the death alone does not require a Modelo 720.
With one account and enough time, you can still fill it in by hand. With several accounts, several names and statements that do not show who owns and who is only authorised, applying the rules stops being realistic.
Aitax reads the statements and leaves you the 720 figures. You check who you are on each asset and the percentage, then you file on the AEAT site.
Do I have to file Modelo 720 if my share of a joint account is under €50,000?
You may still have to. Hacienda looks at the whole balance, not your share. If that account plus your other foreign accounts is over €50,000 on 31 December, you file. When Modelo 720 is required.
How is Modelo 720 filed in gananciales if only one spouse is on the bank contract?
The spouse who signed puts code 1 and 100 %. The other puts code 8 and 50 %. Both put the full value. Both file if each is a Spanish tax resident.
Does an authorised person on a foreign account have to file Modelo 720?
On accounts, they may have to if they are over €50,000. On shares or funds, no. If you are also the owner, you only file as holder.
Do you have to file Modelo 720 when someone dies?
If that person had already filed (or should have), Hacienda must be told they are no longer the holder. If the assets never reached €50,000, the death does not open a new 720.
Does the unaccepted estate file Modelo 720, or do the heirs?
The unaccepted estate files until someone accepts. The heirs file from the moment they accept — even in practice and not before a notary.
You upload the statements. You check who is on each asset and the percentages. You file on the AEAT site.
Upload your statements and generate the file for Hacienda.
